I just noticed one my HID's are brighter then the other and are they covered under the warranty "wear and tear" if so my warranty is already up or is it under the 70K warranty????

70,000 mile is for drivetrain only... your warranty is up for the lights.

Sometimes when one looks brighter its because of the angle of the beam rather than the bulb, the dealer should check and adjust your lights when you bring it in for service.
