Advertising Fee

Ok, I know this was brought up about two months ago, but I couldn't find the thread. Can anybody tell me legally what is the deal with the 1.25% Lexus dealer advertising fee. They will take the base MSRP and multipy that times 1.25 % to get the advertising fee charged each car. In this case for the 5-speed, it is $29,435 * 1.25% = $367.94. I have a problem when I order a car and they didn't have to advertise one bit for it.
